By accessing or using Boop the Barn ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
Boop the Barn is a platform that helps users discover farms, zoos, sanctuaries, aquariums, and other animal-related venues. We provide listings, trip planning tools, reviews, and merchandise. We do not own, operate, or guarantee the accuracy of third-party venues listed on our Service.
To access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate, current, and complete information at registration.
Certain features (including Attraction Owner plans) require a paid subscription. Subscriptions are billed in advance on a monthly or yearly basis. By purchasing a subscription, you authorize us (via Stripe) to charge your payment method on a recurring basis. You may cancel your subscription at any time through the customer portal. Cancellations take effect at the end of the current billing period. Fees already paid are non-refundable except as required by law.
You retain ownership of content you submit to the Service, including reviews, photos, and venue information. By submitting content, you grant Boop the Barn a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute that content in connection with the Service. You are solely responsible for content you submit, and you represent that you have all necessary rights to submit it.
You agree not to use the Service to: (a) violate any law or regulation; (b) post false, misleading, defamatory, or infringing content; (c) harass or harm other users; (d) attempt to gain unauthorized access to the Service or other users' accounts; (e) interfere with or disrupt the Service; or (f) use automated systems (bots, scrapers) without prior written permission.
Venue information displayed on Boop the Barn is sourced from venue owners, public records, and third-party data providers. We do not guarantee the accuracy, completeness, or current status of any listing. Your interactions with third-party venues are solely between you and the venue. We are not responsible for any loss, injury, or damage arising from your visit to any venue.
Physical merchandise purchased through our store is fulfilled by third-party providers. Shipping, returns, and product quality are subject to the policies of those providers. We reserve the right to cancel any order at our discretion with a full refund to the original payment method.
The Service, including its design, logos, text, and software, is owned by Boop the Barn and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Service will immediately cease. Sections that by their nature should survive (e.g., intellectual property, limitation of liability, governing law) will survive termination.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOP THE BARN AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Boop the Barn, its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date below. Material changes will be communicated by posting the updated Terms on this page. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in the United States.
